Residential Tenancy Agreement 2020 Fair Trading

Tenants and landlords can agree that in addition to the standard terms, additional terms apply to the contract. Additional terms may not contradict or modify the standard terms, or attempt to exclude any of the standard terms from application to the agreement. On behalf of the Rental Bond Board, Fair Trading offers a rental loan, custody and repayment service. The Rental Bond Board is an independent and impartial custodian of the rental obligations paid by tenants for rentals in NSW. Although it is strongly recommended that landlords and tenants deduct the agreement in writing, just because an agreement is fully or partially oral does not mean that it is not legally valid. Oral agreements are subject to the same standard conditions. In addition to the current material facts, from 23 March 2020, a landlord or agent also reveals whether the property is available: NSW Fair Trading now has the power to settle disputes between tenants and landlords about repairs and maintenance, as well as property damage. These include the possibility of placing corrective orders. The improvement process helps tenants and landlords resolve disputes regarding repairs and damages in a rental agreement by working with Fair Trading. Before signing an agreement, a lessor or agent must also inform a tenant of any proposed sale of the property if the lessor has prepared a contract of sale or when a mortgage borrower (i.e. the bank or other lenders) takes legal action for the ownership of the property.
